Definitions

“Company” / “We” / “Us” / “Our” refers to Poggi’s Animal House LLC, based in Florida.

“Buyer” / “Customer” / “You” refers to any individual or entity that visits our website, completes a form, places a deposit, or purchases an animal.

“Services” refers to the sale of exotic animals, including monkeys, and related website services such as informational content, contact forms, and customer communications.

Deposits and Payments

ALL DEPOSITS AND PAYMENTS ARE NONREFUNDABLE!

If you have placed a down payment or entered into a layaway plan (which must be paid in full within twelve (12) months from the date the first deposit is received) and later change your mind about purchasing a monkey, all monies are forfeited. Failure to complete payment within the one-year period will also result in forfeiture of all monies paid.

Health and Liability

Monkeys and exotic animals, like all living creatures, are subject to natural health changes and mortality risks that may occur without warning. By purchasing an animal from Poggi’s Animal House LLC, you acknowledge and agree to the following:

• All monkeys are delivered with a Health Certificate from a USDA Certified veterinarian.
• Poggi’s Animal House is released of ALL LIABILITY upon delivery or pickup of a certified healthy monkey from our certified veterinarian.
• Once you have taken possession of your monkey, you are 100% fully responsible for having your USDA Certified Veterinarian examine the monkey a second time within two (2) days of receiving your monkey. You are then required to send us the “Health Inspection Report” from your USDA Certified veterinarian via text or email.
• Poggi’s Animal House is not obligated to replace any monkey that has been certified healthy by our USDA Certified veterinarian.
• If your monkey dies, there are no refunds, replacements, or discounts under any circumstances once the animal is delivered or picked up with a USDA health certificate.
• Failure to complete the required two-day veterinary inspection and submit the report is deemed acceptance of the animal’s condition and forfeits any right to dispute the sale.

Buyer Responsibilities

• Buyer is responsible for understanding and complying with all federal, state, and local laws and regulations regarding exotic animal ownership.
• Buyer assumes all risks, responsibilities, and liabilities related to the care, handling, housing, feeding, and long-term wellbeing of the purchased monkey.
• Poggi’s Animal House LLC does not provide ongoing care, training, or guarantees regarding temperament, future health, or suitability of the animal.

Slander and Defamation

By purchasing from Poggi’s Animal House LLC, you agree that you will not slander, defame, or publish false statements about our business, staff, or operations in any verbal, written, or online format including social media, blogs, forums, or review platforms. Legal action may be pursued to the fullest extent allowed by law for any defamatory or slanderous behavior.

Collection and Use of Personal Data

• We collect personal information that you voluntarily provided through website forms (e.g., name, phone number, email address, location, and any additional information you provide).
• Data is used solely for communication, order processing, and customer support.
• We do not sell, rent, or trade your personal data to any third parties.
• Data may be shared with trusted third parties only as necessary to complete services (e.g., shipping providers, veterinarians, or payment processors).
• By submitting your information, you consent to its collection and use in accordance with these terms.

Communication Opt-In and Opt-Out

By providing your phone number or email through our website forms, you consent to receive communications from Poggi’s Animal House LLC. Transactional messages may include order confirmations, appointment reminders, and account notifications; marketing messages may include special offers, discounts, and updates about new products or services. Message frequency may vary, and standard message & data rates may apply. You can obtain assistance by replying “HELP” to text messages and may opt out of marketing at any time by replying “STOP” or by contacting us directly. Opting out of marketing does not affect delivery of essential transactional messages related to your purchases or account.

Intellectual Property

Indemnification

You agree to indemnify and hold harmless Poggi’s Animal House LLC, its affiliates, and representatives from any claims, damages, or expenses arising from your use of this website or purchase of animals, including but not limited to violation of laws, negligence, or improper care of the animal.

No Warranties

All animals are sold “as is” at the time of delivery. There are no warranties, expressed or implied, regarding the animal’s future health, behavior, or lifespan. No refunds, replacements, or discounts will be issued under any circumstances.

Governing Law and Jurisdiction

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Florida. Any disputes shall be resolved exclusively in Broward County, Florida. It is illegal for us to do business with anyone who does not live in the United States or within the following states inside the U.S.: Alaska, Arizona, California, Colorado, Connecticut, Georgia, Hawaii, Illinois, Iowa, Kentucky, Louisiana, Maine, Maryland, Massachusetts, Minnesota, New Hampshire, New Jersey, New Mexico, New York, Oregon, Pennsylvania, Utah, Vermont, Washington. If you live in any of these areas, we will keep you on our mailing list in case you move to a location where it is legal for you to own exotic animals

Changes to Terms

We reserve the right to update or modify these Terms at any time without prior notice. Continued use of our website or services after changes are posted constitutes acceptance of the revised Terms.

Acknowledgment

By submitting a deposit, making any payment, or taking possession of an animal from Poggi’s Animal House LLC, you confirm that you have read, understood, and agree to all terms outlined above.
